Standard Terms and Conditions for Domestic Travel

Article 1 (Purpose)

These terms and conditions are intended to specify the details of the implementation and compliance of the domestic travel contract concluded between Aju World Travel and travelers.

Article 2 (Obligations of Travel Agents and Travelers)

① In order to provide safe and satisfactory travel services to travelers, travel agents must faithfully perform their assigned duties in the process of establishing and executing travel plans, such as travel arrangements, guidance, transportation, and accommodations.

② In order to ensure a safe and enjoyable trip, travelers must actively cooperate with the travel agent in promoting harmony among travelers and maintaining travel order.

Article 3 (Types and Definitions of Travel)

The types and definitions of travel are as follows:
1. Hopeful travel: Travel conducted by travel agents according to the travel conditions desired by travelers.
2. General recruitment travel: Travel conducted by recruiting travelers according to the travel conditions established by travel agents. 3. Consignment Recruitment Tour: A tour in which the travel agent entrusts another travel agent with recruiting travelers for a recruited travel product.

Article 4 (Contract Composition)

① The travel contract consists of the travel contract (attached), travel terms and conditions, and travel itinerary (or travel brochure).

② The travel itinerary (or travel brochure) must include the travel destination, sightseeing content, transportation, number of shopping trips, accommodations, meals, etc. for each travel date, as well as the travel agency-provided services, and traveler-related matters to note.

Article 5 (Special Agreement)

Travel agents and travelers may enter into a special agreement in writing within the scope that does not violate relevant laws and regulations. In this case, the travel agent must explain to the traveler any differences from the standard terms and conditions.

Article 6 (Delivery of contracts, terms and conditions, etc.)

When a travel agent enters into a travel contract with a traveler, it must deliver one copy each of the contract, travel terms and conditions, and travel itinerary (or travel brochure) to the traveler.

Article 7 (Deemed delivery of contracts, terms and conditions, etc.)
In the following cases, the travel agent is deemed to have delivered the travel contract, travel terms and conditions, and travel itinerary (or travel brochure) to the traveler. 1. If a traveler agrees to the contents of the travel contract, terms and conditions, and travel schedule (or travel brochure) provided through an electronic information network such as the Internet and applies for the conclusion of a travel contract, and the travel agent notifies the traveler of its intent to accept the travel using an electronic information network or mechanical device, etc.
2. If a traveler agrees to the contents of the travel contract, terms and conditions, and travel schedule (or travel brochure) provided by the travel agent using a mechanical device such as a facsimile and sends a written application for the conclusion of a travel contract, and the travel agent notifies the traveler of its intent to accept the travel using an electronic information network or mechanical device, etc.

Article 8 (Responsibility of Travel Agents)

① The travel agent shall be liable for any damage caused to the traveler intentionally or negligently by the travel agent or its employees, local travel agents, or its employees (hereinafter referred to as “employees”) in relation to the travel agent’s duties as stipulated in Article 2, Paragraph 1 from the time of departure to the time of arrival. ② The travel agent shall compensate for damages suffered by the traveler due to delays in the departure and arrival of transportation such as aircraft, trains, and ships, or traffic congestion. However, this shall not apply if the travel agent proves that there was no intent or negligence.

③ The travel agent shall compensate for damages caused by loss, damage, or delay of the traveler's luggage, unless the travel agent proves that he or she or his or her employee did not neglect due care in receiving, delivering, or storing the traveler's luggage.

Article 9 (Cancellation of contract when minimum number of participants is not met)

① If the travel agent cancels the travel contract because the minimum number of participants is not met, the travel agent shall notify the traveler at least 24 hours prior to departure for same-day trips, and at least 48 hours prior to departure for trips of 1 night and 2 days or more.

② If the travel agent cancels the contract without notifying within the period of the preceding paragraph due to the number of participants being insufficient, the travel agent must compensate the traveler with 100% of the contract deposit in addition to refunding the deposit already paid.

Article 10 (Refusal to Enter into a Contract)

A travel agent may refuse to enter into a contract with a traveler if the traveler falls under any of the following reasons:
1. When it is deemed that the traveler is causing inconvenience to other travelers or hindering the smooth operation of the trip
2. When it is deemed that the trip is difficult due to illness or other reasons
3. When the maximum number of participants specified in the contract is exceeded

Article 11 (Travel Fee)

① The basic fee includes the following items. However, the desired trip is subject to agreement between the parties. 1. Fares for transportation agencies such as airplanes, ships, and railways (standard fares)
2. Shuttle bus fares between airports, stations, docks, and hotels
3. Accommodation and meal fees
4. Guide expenses
5. Various taxes required during the trip
6. Domestic airport and port usage fees
7. Entrance fees to tourist attractions listed on the itinerary
8. Other costs according to individual contracts
② When entering into a contract, the traveler must pay the travel agent a deposit (an amount less than 10% of the travel fee), and the deposit is treated as all or part of the travel fee or damages.
③ The traveler must pay the travel agent the remaining balance of the travel fee in Paragraph 1, excluding the deposit, by the day before the departure date.
④ The traveler must pay the travel fee in Paragraph 1 by the method (giro account, bank transfer, etc.) designated by the travel agent. ⑤ If the desired travel fee includes the traveler's insurance premium, the travel agent must explain the insurance company name, compensation details, etc. to the traveler.

Article 12 (Requirements for Changes to Travel Conditions and Settlement of Fees, etc.)

① The travel conditions in Articles 1 through 11 above may be changed only in the following cases:
1. In cases where both parties agree that it is unavoidable for the safety and protection of the traveler at the traveler's request or due to local circumstances
2. In cases where the purpose of the trip cannot be achieved due to natural disasters, war, government orders, strikes, or suspensions of operations of transportation or accommodation facilities, etc.

② In cases where the travel fee in Article 11, Paragraph 1 increases or decreases due to changes in the travel conditions in Paragraph 1, the portion changed before the departure of the trip must be settled (refunded) before the departure of the trip, and the portion changed during the trip must be settled (refunded) within 10 days after the end of the trip.

③ In the event that damages arise due to changes in travel conditions other than those provided for in Paragraph 1 or due to cancellation or termination of the contract pursuant to Article 13 or 14, the amount incurred prior to the departure of the trip must be settled (refunded) prior to the departure of the trip, and the amount incurred during the trip must be settled (refunded) within 10 days after the end of the trip. 
④ If a traveler fails to receive services included in the travel fee, such as accommodation, meals, or sightseeing, due to his/her own circumstances after the departure of the trip, he/she cannot claim a refund of the corresponding fee from the travel agent. However, if the trip is terminated midway, it will be processed in accordance with Article 14.

Article 13   (Cancellation of Contract before Departure of Trip)
① The travel agent or traveler may cancel this travel contract prior to departure. In this case, the amount of damages incurred will be compensated in accordance with the ‘Consumer Damage Compensation Regulations’ (Ministry of Strategy and Finance Notice).
② The travel agent or traveler may cancel this travel contract without paying the damages stipulated in Paragraph 1 to the other party if any of the following reasons apply before the departure of the trip.
1. Cases in which the travel agent may cancel

a. Cases in Subparagraphs 1 and 2 of Paragraph 1 of Article 12

b. When the traveler is deemed to have caused inconvenience to other travelers or significantly hindered the smooth operation of the trip

c. When the traveler is unable to participate in the trip due to illness or other physical abnormalities

d. When the traveler does not pay the travel fee by the due date stated in the contract
2. Cases in which the traveler may cancel

a. Cases in Subparagraphs 1 and 2 of Paragraph 1 of Article 12

b. When a relative within the third degree of kinship of the traveler dies

c. When the traveler is unable to participate in the trip due to illness or other physical abnormalities

d. If a spouse or direct ascendant is hospitalized for more than 3 days due to a physical disability and is difficult to discharge by the time of departure, the spouse or guardian 1 person

Ma. If it becomes impossible to carry out the travel according to the travel schedule stated in the contract due to the fault of the travel agent

Article 14 (Cancellation of contract after departure)

① The travel agent or traveler may cancel this contract after departure due to unavoidable circumstances. However, the traveler must compensate for any damages incurred by the other party as a result.

② If the contract is canceled according to the provisions of Paragraph 1, the travel agent must cooperate with the traveler in matters necessary to return home, and the traveler shall bear any expenses necessary for this that are not due to the fault of the travel agent.

Article 15 (Start and end of travel)

The start of the travel begins at the time of departure and ends when the travel schedule ends and the traveler arrives at the final destination. However, this does not apply when changing the contract or schedule.

Article 16 (Duty to Explain)

The travel agent must explain the important contents and changes to these terms and conditions so that the traveler can understand them.

Article 17 (Insurance Subscription, etc.)

The travel agent must subscribe to insurance or mutual aid or deposit a business guarantee to pay insurance money to the traveler in case of damages incurred to the traveler in relation to the travel.

Article 18 (Other Matters)
① In the event of a dispute regarding matters not specified in this contract or the interpretation of this contract, the travel agent and the traveler shall reach an agreement and decide; however, if no agreement is reached, the relevant laws and general practices shall apply. 
② In the case of travel to a special region and there is a justifiable reason, the contents of the terms and conditions may be different.
